When Is a Parenting Plan Required?

Under Section 33(2) of the Children’s Act 38 of 2005, parents who share responsibilities and are experiencing difficulties must attempt to agree on a parenting plan before approaching the court.

In other words, parenting plan mediation is not optional in many cases — it is the first step in resolving parenting disputes legally and effectively.

Child Participation in Mediation (Section 10)
