Our international divorce lawyers in South Africa can help with divorce matters involving parties outside the Republic.
We assist clients in approaching the Court for permission to deliver a Divorce Summons internationally. This Court Order can be obtained with or without the other party’s consent. If no consent is given, we must provide valid reasons to the Court for seeking permission.
The application for this permission is called an Application for Edictal Citation. Sometimes, it is necessary to request the Court to allow service via email, fax, or other digital means. In these cases, the Application for Edictal Citation includes a request for Substituted Service, allowing the Divorce Summons to be served digitally.
Our international divorce lawyers will guide you through every step of your divorce process, no matter where your spouse is located.
For international divorce matters, we prepare an affidavit supporting your request for international service of the Divorce Summons. Once signed, we lodge the affidavit at Court, which then sets a hearing date. We represent you at the hearing and present reasons for international service. After considering the reasons, the Court issues an Order allowing us to serve the Divorce Summons internationally.
The Divorce Summons can be served in various ways, such as through the embassy or consulate, by international equivalents of the Sheriff of the Court, or by electronic means.
