Protection of Personal Information in Legal Matters

The coming into effect of the Protection of Personal Information Act 4 of 2013 (POPIA) entrenched the confidentiality and protection of personal information in South Africa. In this digital age and the advancement of technology, the use and abuse of cyberspace have made it necessary for measures to be put in place to safeguard the fundamental rights to privacy of individuals and institutions. As a ripple effect, consequently, many individuals are no longer willing to divulge their personal information unnecessarily for fear of misuse.

Confidentiality Challenges in Court Proceedings

It may also happen that in court proceedings, a party may deliberately take measures for the other party not to acquire their personal details, for various reasons which include the risk of physical harm, stalking, all forms and manner of abuse, etc. However, the court proceedings must go forward, and documents must be served to effect proper service—this does put the other party in a dilemma, doesn’t it? Maybe not really.

There are ways around which this situation may be contained on both sides.

What Happens When a Spouse Withholds Their Address?

In the event that, in a divorce matter, one spouse withholds personal information like an address from the other spouse who wants to institute divorce proceedings, or where the spouses separated many years prior and the instituting spouse has no idea where the other spouse now lives, there is a legal process that can be followed.

Substituted Service: When a Spouse's Address Is Unknown

There is a process known as substituted service, whereby a request is made to court for the divorce summons to be published in a newspaper that circulates in the locality of where the other spouse ordinarily lives or was last known to reside. However, before such a request is granted, facts must be put before the court to show that the plaintiff has made reasonable and satisfactory efforts to acquire the address of the defendant, without success.

Such proof may include:

  • A Tracer’s certificate confirming that attempts to locate the spouse have failed.
  • Affidavits from relatives of the defendant attesting that they also have no idea where the defendant resides.

It is important to note that in divorce matters in South Africa, personal service of summons is required, so the court will not grant the request for substituted service easily.

Alternative Address for Service of Court Documents

On the other hand, the party intending to safeguard their personal details may, in their notice to defend, provide an alternate address (e.g., a legal representative’s place of business or a third-party address) where they will accept service of all court process. In a way, this helps protect their privacy and minimizes the risk of personal information being misused.

Disclosure of Information in Court Proceedings

Despite confidentiality concerns, during the discovery stage (Rule 35), some information may need to be disclosed unless the court orders otherwise. Either party may launch an application to compel the disclosure of certain specific information if they require it to proceed with the matter. If withholding the information frustrates the case, the court will step in and make a decision as necessary.
